agreed to be bound by the Terms of Service described in this document.
Tolcap has the right to update and change the Terms of Service from time to time without notice. Any new functionality
or services that change or enhance the current Service shall be subject to these Terms of Service. If you continue to use
the Service after any such changes you agree to such changes and their meaning. The applicable version of the Terms of

Account Terms
Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.
You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws
in your jurisdiction (including but not limited to copyright laws).
You are responsible and liable for all content posted to the Service and any activity that occurs under your account.
To use this Service you must be 16 years of age or older.
To complete the signup process, you must provide all information requested including your full legal name and a valid email
address.
Accounts registered by automated methods are not permitted.
For login, each user will be given a unique user name and password combination.
A user name / login may only be used by one person.
Each user is responsible and liable for maintaining the security of their user name and password. Tolcap will not be liable
for any loss or damage from failure to comply with this security obligation.
Violation of any of the terms in this document will result in the termination of your account.
Technical support is provided via the application's feedback feature. (Tolcap aims to respond within 24 business hours, but
is under no obligation to do so).
You are not allowed to modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated
with the Service, Tolcap, Capra Technology or any other Codebase Consulting service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access
to the Service without the express written permission by Tolcap.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Tolcap customer, employee, member,
or officer will result in immediate account termination.
You understand that the technical processing and transmission of the Service, including your content, may be transferred
unencrypted and involve transmissions over various networks; and changes to conform and adapt to technical requirements of
connecting networks or devices.
If your bandwidth usage exceeds 100 MB/month, or significantly exceeds the average bandwidth usage (as determined solely by
Tolcap) of other Tolcap customers, we reserve the right to immediately disable your account or reduce the Service or its
availability to you until you can reduce your bandwidth consumption.
All trial account activity is monitored and in some cases recorded. This is used to provide support, improve quality and prevent fraud.
Tolcap does not warrant:
- the Service will meet any specific requirements including but not limited to yours;
- the Service will be uninterrupted, timely, secure, or error-free;
- the results that obtained from the use of the Service will be accurate or reliable;
- the quality of any products, services, information, or other material purchased or obtained by you through the service
will meet your expectations;
- any errors in the Service will be corrected.
You expressly understand and agree that Tolcap can and shall not be liable for any direct, indirect, incidental, special,
consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other
intangible losses (even if Tolcap has been advised of the possibility of such damages), resulting from:
- the use or the inability to use the service;
- the cost of procurement of substitute goods and services resulting from any goods, data, information or services
purchased or obtained or messages received or transactions entered into through or from the service;
- unauthorized access to or alteration of your transmissions or data;
- statements or conduct of any third party on the service;
- or any other matter relating to the service.
The failure of Tolcap to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of
such right or provision or any other right or provision or term described in the terms of Service. The Terms of Service constitutes
the entire agreement between you and Tolcap and govern your use of the Service, superseding any prior agreements between you and
Tolcap (including, but not limited to, any prior versions of the Terms of Service).
We claim no intellectual property rights over the material you provide to the Service. Your profile, content and materials
uploaded and posted to the Service remain yours. You agree to allow others to view and share your content and you agree and
allow Tolcap to distribute this content in any way, shape or form or by any means, including but not limited to electronic
distribution across computer networks. Tolcap does not pre-screen content, but Tolcap and its designee have the right (but
not the obligation) in their sole discretion to refuse or remove any content that is available via the Service.
Tolcap reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the
Service (or any part thereof) with or without notice.
Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change
without prior notice. Such notice may be provided at any time by posting the changes to the Tolcap website
www.tolcap.com or the Service itself but Tolcap is under
no obligation to do so.
Tolcap shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance
of the Service.
You are solely responsible and liable for properly canceling your account. An email, telephone, fax or written request
to cancel your account is not considered cancellation. You can only cancel your account by leaving all or your active and
inactive workspaces.
All of your content will be immediately deleted from the Service upon cancellation. Content cannot be recovered once your
account is canceled. You understand and agree to this condition.
Tolcap, in its sole discretion, has the right to suspend or terminate any account and refuse any and all current or future
use of the Service, or any other Tolcap service, for any reason at any time. Such termination of the Service will result in
the deactivation or deletion of your account and content or your access to your account and content, and the forfeiture and
relinquishment of all content in your account.
If an account remains inactive for 12 months, it will be disabled.
Tolcap reserves the right to refuse service to anyone for any reason at any time.
Tolcap reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the
Service (or any part thereof) with or without notice.
Tolcap usage payments become due at the start of a calendar month. Should you cancel the service part way through a month a refund
will not be payable.
